Terms of Service

These terms are an agreement between you and Red Dog Road, Inc., doing business as Mándalo (“Mándalo,” “we,” “us”). They apply when you use the Mándalo service, including our phone numbers, WhatsApp accounts, website, and payment links. If you use Mándalo for a business, you accept these terms for that business and confirm you can do so.

1. Who can use Mándalo

Mándalo is for businesses. You must be at least 18 and able to enter into contracts. Business owners can invite team members, such as crew leads, and are responsible for what they do in Mándalo.

2. The service

Mándalo helps you run your business by text: it keeps client and job records, drafts quotes and invoices, keeps your schedule, sends messages you approve, and creates payment links. Mándalo is currently in a pilot. Features may change, and we may add, change, or remove features as we learn what works.

3. Your information

Your business records and the content you send us belong to you. You give us permission to store, process, transcribe, translate, and transmit them only as needed to provide and support the service, as described in our Privacy Policy. You are responsible for the accuracy of the information you provide and for having the right to share your clients’ information with us.

4. Drafts made with AI

Mándalo uses AI to transcribe, translate, and draft quotes, invoices, and messages. AI can make mistakes. Review prices, quantities, taxes, dates, and wording before you approve anything. You are responsible for what is sent with your approval, including when you turn on automatic sending for a kind of message.

5. Messaging your clients

You may use Mándalo to message only clients who have agreed to receive texts from your business about their service. You agree to follow the laws that apply to text messages, calls, and email, including the Telephone Consumer Protection Act and CAN-SPAM. Mándalo automatically honors STOP requests, and you agree not to message people who have opted out. Our SMS Terms describe the messaging program.

6. Payments

Card and bank payments are processed by Stripe. To accept them, you must agree to Stripe’s Connected Account Agreement, and Stripe’s terms govern how payments, payouts, refunds, and disputes work. Mándalo is not a bank or money transmitter and does not hold your funds. Payments made outside Mándalo, such as cash, checks, or Zelle, are recorded only for your records.

7. Fees

Pilot pricing is whatever we agree with you in writing. We will tell you about any fees, including payment processing fees, before you incur them, and give you at least 30 days’ notice before we change them.

8. Acceptable use

Don’t use Mándalo to break the law, send spam or messages people haven’t agreed to receive, harass anyone, infringe others’ rights, interfere with the service, or try to access accounts or data that aren’t yours.

9. Third-party services

Mándalo relies on third-party services such as mobile carriers, WhatsApp, and Stripe. Their availability is not fully in our control, and their own terms may apply to you.

10. Ending the service

You can stop using Mándalo at any time. We may suspend or end access if you break these terms or if needed to protect the service or others. Either way, you can ask for an export of your business records within 30 days.

11. Disclaimers

Mándalo is provided “as is” and “as available.” To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We don’t promise the service will be uninterrupted or error-free, or that every message will be delivered.

12. Limitation of liability

To the extent the law allows, Mándalo is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue. Our total liability for any claim related to the service is limited to the greater of the fees you paid us in the 12 months before the claim or $100.

13. Indemnity

You agree to defend and indemnify Mándalo against claims arising from your content, your messages to your clients, or your violation of these terms or the law.

14. Governing law

These terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located there, unless we agree otherwise in writing.

15. Changes

If we make material changes to these terms, we will update the date above and notify you at least 30 days before they take effect. If you keep using Mándalo after that, the new terms apply.
